Using TripZILLA
1.1
Age restrictions
TripZILLA is designed for professional use by travel advisors and businesses. You must be at least 16 years old to create an account and use the Platform.
If you are under 16, you may only use TripZILLA with verifiable parental or guardian consent and only if permitted by the applicable law in your country (for example, under the GDPR the minimum digital consent age is 16, unless local law sets it lower, but never below 13).
We may request proof of age or consent and may terminate accounts that fail to meet these requirements.
1.2
Shareable itinerary links
Some features allow you to generate shareable links containing itinerary information. You are solely responsible for distributing these links. TripZILLA is not liable for any disclosure, misuse, or unauthorized access resulting from shared links.
2.
Third-Party Services and Integrations
TripZILLA may integrate with third-party services, including those related to payments, bookings, data aggregation, content display, analytics, and customer relationship management.
Your use of any third-party service is subject to its own terms and conditions. We do not control and are not responsible for the content, performance, legality, or availability of third-party services.
If you choose to connect such services through our Platform, including by using your own credentials or API keys, you do so entirely at your own risk. TripZILLA is not liable for any losses, disputes, or damages arising from your use of third-party services. Any interactions with those services are solely between you and the provider. We may share limited data with these services as described in our Privacy Policy.
3.
Rights on using TripZILLA
3.1
Right to Access and Use
You are granted a limited, non-exclusive, non-transferable right to access and use the Platform for professional or business purposes, subject to this Agreement.
3.2
Right to Manage Your Content
You retain control over the content you create or upload (including itineraries, customer details, and media). You may edit or delete your content at any time, unless your account is suspended or terminated.
3.3
Right to Data Portability
If you are an individual covered by the GDPR, you may request a copy of your personal data in a structured, commonly used, machine-readable format. This right applies only to data processed on the basis of consent or a contract. This right does not apply to company accounts, unless the account is used by an individual acting independently, such as a self-employed travel agent. To request your data, contact us at [email protected]. We will respond within 30 days, subject to identity verification.
3.4
Right to Receive Support
During your active subscription, you are entitled to basic support for issues related to bugs, technical problems, or general use. Support is provided exclusively via email at [email protected]. We aim to respond within 48 hours on business days. While response times may vary and are not guaranteed, we make every reasonable effort to address urgent issues quickly.
3.5
Right to Privacy and Security
Your data is protected in accordance with our Privacy Policy and applicable laws, including the GDPR where relevant. We implement appropriate technical and organizational measures to protect personal data, and follow a “privacy by design and by default” approach. Two-factor authentication (2FA) is enabled by default.
You are responsible for keeping your login credentials secure. Disabling security features is not permitted unless explicitly authorized. If you suspect unauthorized access or a breach of your account, notify us immediately at [email protected].
3.6
Right to Close Your Account
You may terminate your account at any time. Upon termination, you can request deletion of your itineraries, client data, images, and other materials (“Customer Content”), subject to legal retention obligations. To request deletion, contact [email protected].
4.
Restrictions on Use
When using TripZILLA, you agree not to:
1.
Use the Platform for unlawful purposes
Including (but not limited to) violating applicable laws, regulations, or the rights of others.
2.
Upload or transmit harmful content
Such as malware, viruses, worms, or any content that is abusive, defamatory, threatening, harassing, obscene, or otherwise inappropriate.
3.
Infringe on intellectual property rights
This includes uploading, sharing, or otherwise using content you do not own or have permission to use, such as copyrighted travel materials, logos, or third-party data.
4.
Attempt to reverse engineer or tamper with the Platform
Including decompiling, disassembling, or otherwise attempting to discover the source code or underlying algorithms of any part of TripZILLA.
5.
Circumvent security or access controls
You may not attempt to gain unauthorized access to TripZILLA, other user accounts, or related systems or networks.
6.
Resell, sublicense, or commercially exploit the Platform
Unless expressly permitted in writing by TripZILLA. For example, you may not resell access, white-label the Platform, or share your login with others.
7.
Use automated systems without permission
Including bots, crawlers, or scripts that interact with the Platform in ways not intended by TripZILLA, unless explicitly authorized.
8.
Misrepresent yourself or your affiliation
You may not falsely claim to represent a business, individual, or organization that you do not actually represent.
9.
Engage in spamming, phishing, or sending unsolicited messages
You may not use the Platform to send unsolicited messages, advertisements, or promotional content, or to engage in phishing or other deceptive practices.
10.
Scrape or extract data without permission
Automated data scraping, data mining, or extraction from the Platform is prohibited unless explicitly authorized in writing by TripZILLA.
11.
Overload or disrupt the Platform
You may not place excessive burden on TripZILLA’s infrastructure or attempt to interfere with its normal operation.
12.
Sharing account access or credentials to avoid license fees
Each account is personal and linked to a specific seat. Users may only access the Platform through their own assigned account. Sharing accounts, login credentials, or granting access to individuals not included in your subscription is strictly prohibited.
Any attempt to bypass, exceed, or otherwise circumvent the number of seats allocated to your subscription without properly adding additional seats through the Platform is strictly prohibited. Accounts created through automated methods, such as bots or generic team accounts intended for shared use, are not permitted. All users must be identifiable individual human beings. If a user wishes to invite another person or organization, either internal or external, this must be done directly through the Platform or by contacting TripZILLA at [email protected].
TripZILLA reserves the right to monitor compliance by legally permissible means (including IP and session tracking, cookie tracking, and other methods).
Failure to comply with these Terms may result in immediate suspension or termination of access to the Platform. TripZILLA reserves the right to seek recovery of unpaid or underpaid subscription fees in accordance with applicable law.
5.
Team members and data sharing
TripZILLA allows to invite and add multiple users to a team. All users within a team may have access to shared content, including itineraries, customer details, and uploaded files. The account administrator is responsible for managing permissions and ensuring that data sharing within the team complies with applicable laws. By participating in a team, you agree that your data and activity may be visible to other members of the same team.
6.
Payments and Refunds
6.1
Subscription Plans
TripZILLA is offered on a subscription basis with multiple tiers, including a Core, Pro and Business plan. Subscriptions may be billed monthly or annually, with discounted pricing available for annual commitments. The features, billing intervals, and current prices for each subscription tier are published on our Pricing Page and in your account settings and may be updated from time to time. By subscribing, you agree to the fees and billing terms presented at the time of purchase.
6.2
Free Trial
We offer a 7-day free trial for new users. No credit card is required to start the trial, and the subscription will not begin automatically after the trial ends. To continue using the platform after the trial, you must manually choose a subscription plan and provide payment details.
6.3
Merchant of Record
Payments are processed through our authorized reseller, FastSpring, which acts as the Merchant of Record for TripZILLA. When you purchase a subscription, your transaction is with FastSpring, not directly with TripZILLA. FastSpring is responsible for billing, tax collection, and issuing payment receipts. 6.4
Currencies and Pricing
TripZILLA supports multiple currencies. All fees are based on the equivalent of our standard pricing in euros and are converted at checkout. Any foreign transaction fees, currency conversion costs, or bank charges are the responsibility of the customer.
6.5
Payment Terms
Payments are due in advance and are processed securely through our third-party payment provider FastSpring. By subscribing, you authorize us to charge your selected payment method on a recurring basis (monthly or annually) until cancelled.
6.6
Refund Policy
You may request a full refund within 14 days of your initial subscription charge. After this period, all payments are non-refundable, including in cases of early cancellation or unused time. To request a refund, contact [email protected]. Refunds may take several business days to process, depending on your payment provider.
6.7
Chargebacks
All payments for TripZILLA subscriptions are processed by our authorized reseller, FastSpring, who acts as the Merchant of Record. If you believe a charge was made in error, we encourage you to contact us first at [email protected]. We’re happy to investigate and help resolve the issue as quickly as possible. Initiating a chargeback without first contacting us may delay the resolution process. If a dispute is not resolved in our favor, and depending on the circumstances, we may recover any resulting costs where legally permitted.
7.
Upgrade and Renewal
7.1
Upgrade
You may upgrade your subscription at any time, for example by increasing the number of seats or switching to a higher-tier plan. The upgrade will take effect immediately, and you will be charged a prorated amount for the remaining period of your current billing cycle.
Downgrades, such as reducing seats or switching to a lower-tier plan, are not allowed during an active subscription. To downgrade, you must cancel your current subscription and purchase a new one after expiry. This policy exists because we do not offer prorated refunds or partial credits on monthly or annual plans.
7.2
Renewals
Your TripZILLA subscription will automatically renew at the end of each billing cycle (monthly or annually), unless you cancel your subscription before the renewal date. The renewal will be for the same plan and duration as your current subscription, unless otherwise stated at the time of renewal.
We reserve the right to adjust our subscription prices. If we make material changes to our pricing or plan structure, we will notify you in advance via email or through the platform. Any changes will take effect at the start of your next billing cycle unless stated otherwise.
Your continued use of the Platform after such modifications constitutes your acceptance of the changes.
7.3
Cancellation and Termination
You may cancel your subscription at any time via your account settings. Cancellation takes effect at the end of your current billing cycle. Your account will remain active until then, and you will continue to have access during this time. No refunds will be issued for unused time unless required by law. You are responsible for exporting your data before cancellation.
TripZILLA may suspend or terminate your access if you breach this Agreement, fail to pay subscription fees, or engage in activity that harms the integrity, performance, or security of the Platform.
We may also terminate your subscription if we discontinue the Platform or for other valid business or legal reasons. In such cases, if termination is not due to your breach, you will receive a prorated refund of any prepaid subscription fees covering the remaining period.
Data deletion will follow our Privacy Policy and applicable law.
8.
Modifications to Services and Pricing
TripZILLA reserves the right to modify, suspend, or discontinue any aspect of the Platform at any time, including features, functionality, subscription tiers, or pricing. We may update or improve the platform from time to time to enhance performance, security, or usability. While we aim to maintain consistent functionality, certain features may be changed, replaced, or removed as part of ongoing development.
9.
Account security and access
You are solely responsible for maintaining the confidentiality of your login credentials, including access to the email address associated with your TripZILLA account. If you lose access to your registered email inbox, we cannot guarantee recovery of your account or provide an alternative password reset method.
For features that involve encrypted files or data, please note that if the TripZILLA Vault password is lost, we can only reset the encryption key. This will result in the permanent deletion of all previously encrypted files, which cannot be recovered.
10.
Service
We design and improve the TripZILLA Platform with care, drawing from our own expertise and valuable feedback from our users. While we strive to deliver a high-quality experience, we cannot guarantee that the Platform will meet every individual’s specific requirements or expectations.
All features are tested thoroughly before release. However, like any software, our Services may occasionally contain bugs or unintended behavior. We prioritize the resolution of issues that affect security, privacy, or core functionality. Although we actively track and address reported bugs, we cannot guarantee that all issues will be resolved or that the Platform will be completely free of errors.
TripZILLA is committed to maintaining a secure and reliable platform in line with applicable data protection laws, including the GDPR.
11.
Copyright and Content Ownership
11.1
Your Content
You retain full ownership of all content you upload, such as itineraries, client data, and media. TripZILLA does not claim ownership. By uploading content, you grant TripZILLA a limited, non-exclusive, worldwide license to use, process, and transmit your content as necessary to operate the Platform. This license ends when your content is deleted.
You are responsible for ensuring that your content complies with copyright and other laws. TripZILLA does not pre-screen content but reserves the right to remove material that violates these Terms, the law, or third-party rights.
Your content remains private within your account or agency team, unless you explicitly choose to share it (e.g. through an itinerary link). TripZILLA does not make your content public or available to other users without your action.
11.2
Our Content
TripZILLA and its licensors retain all rights, title, and interest in and to the Platform, including all software, design elements, branding, underlying code, databases, and other intellectual property. Nothing in these Terms transfers any ownership of the Platform or its components to you.
You may not reproduce, copy, sell, resell, modify, distribute, or create derivative works from any part of the TripZILLA Platform without express written permission. Use of TripZILLA’s name, logo, or branding for marketing or promotional purposes also requires prior written consent. You may contact us at [email protected] for such requests.
12.
Data Protection and GDPR Comp
Data Protection and GDPR Compliance
TripZILLA B.V., registered in the Netherlands, acts as:
Data Controller for personal data we collect directly from our business customers (e.g., account details, billing, usage analytics, and support communications).
Data Processor for personal data that our customers input about their own clients (travelers). In this context, the customer remains the data controller and TripZILLA acts solely as processor under the terms of our Data Processing Agreement (DPA).
13.
Cookies
TripZILLA uses cookies and similar technologies for session management, analytics, and service improvements. Full details about the types of cookies we use, their purposes, and how you can manage your preferences are explained in our [Cookie Policy].
By using the Platform, you acknowledge that cookies may be placed on your device as described in the Cookie Policy.
14.
Indemnification
You agree to indemnify and hold harmless TripZILLA, its directors, employees, and affiliates from claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from your misuse of the Platform, your content, or your violation of these Terms or applicable law.
15.
Governing Law and Dispute Resolution
These Terms are governed by the laws of the Netherlands.
In the event of a dispute, both parties agree to attempt informal negotiation for up to 30 days. If unresolved, the dispute will be submitted to binding arbitration under the Netherlands Arbitration Institute (NAI), held in Amsterdam, and conducted in Dutch or English. The decision will be final and enforceable in any competent court. Nothing in this clause limits either party’s right to seek injunctive relief for the misuse of intellectual property or confidential information.
If you are using the Platform as a consumer, this arbitration clause does not prevent you from bringing proceedings in the courts of your country of residence, as required by applicable consumer protection law. Your statutory rights remain unaffected.
16.
Liability
To the fullest extent permitted by law, TripZILLA is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business interruption, whether based on contract, tort, negligence, or any other legal theory, even if we have been advised of the possibility of such damages.
TripZILLA’s total liability is limited to the greater of (i) the total amount paid by you in the twelve months prior to the event giving rise to the claim, or (ii) one hundred euros (€100) or the equivalent in your currency.
TripZILLA implements appropriate safeguards in line with the GDPR, but no system is completely immune to security incidents. We are only liable for damages caused by a failure to implement reasonable safeguards, subject to the above limits. Nothing in these Terms limits liability where exclusion is not permitted by law, including for death, personal injury, fraud, or gross negligence.
